Actually there is no such limitation if you read the regs:

There was an article in AutoWeek last year about a man who imported a
XJ220. He hoped to make back some of the small fortune he spent on the
EPA certification by licensing the software he had an Engineering firm
in the UK develop during his certification process and offering the
service to other prospective XJ220 importers.
