Beep at 37 degrees
The sensor is measuring temperature above the road surface. The temperature on the road can be lower than this, especially when wet, due to wind chill factor (and vaporisation effects). Couple this with potential sensing errors and you will see that BMW have to put some margin in to warn you. In the UK, I have detected ice at indicated temperatures of 3 deg C. (37ish deg F.).
