nothing personal, but if it were me I wouldn't touch your car with a ten
foot pole.  I'd expect a discount of a few thousand.  A lawyer may be
cheaper.

Bmw already knows youre a fool bc you bought a $45k car without a decent
back seat (they know I'm an idiot bc I bought one without any backseat
or even a spare tire), and it's possible they will treat you that way.
I once saw the buyer profile issued to bmw salespeople for m3s',
something like they're younger and less well-heeled than typical bmw
buyers.  Chrysler/jeep treated me like a sap up until the day they
returned all my money with interest.  I think I would have fared better
if I had whited out "Patent trademark copyright" from my letter head :-)
fact is, they lost almost nothing in the deal except, retroactively, the
sale.

If it were a 15k taurus, I'd say take your lumps bc I lost a lot of
soldiers in winning my battle.  But with a 45k car you stand to lose a
lot.  Plus, I imagine bmw is still smarting from the bmw v gore thing
even though they did duck the big bullet (mondo punitives).  I haven't
the foggiest idea what your rights are under consumer law, you may be
outside of the lemon law period, but the warranty has to count for
something.  

I kept waiting for chrylser to behave as if they wanted happy customers,
they never did even remotely.  Bmw and roslyn may have already written
you off as a lost sale.  Send everything certified mail, return receipt
requested.  Make sure all service orders are filled out completely and
accurately before and after service, and signed.  

At this point I wouldn't drive a v8 grd chero if it were the only way
out of a burning building.  But if you still love the car, consider
making an offer to bmw or the dealer: trade your car (retail value with
deduction for the mileage up until it stopped running right) for a new
m3 (with same price over invoice as yours).  That's more than fair and
they lose nothing bc they essentially retain the profit on the first
sale.

My biggest advice: nip it in the bud now.  my lemon fiasco was the worst
experience of my life outside the deaths of family members.
