Ruling in dangerous driving case (NAC)

(08:10) A District Judge has said that any motorist caught in a traffic
tailback behind a slow driver should assume that the person holding up
the traffic is an idiot. 

The comments were made by Judge William Harnett at a sitting of
Thomastown District Court in Kilkenny during a case involving a Dublin
motorist who overtook a slow-moving car on the hard shoulder after being
caught in a tailback for a number of miles. 

24-year-old Keith Kirwan from Ridgewood Green, Forest Road, Swords
pleaded guilty on Monday to dangerous driving last December on the road
between Waterford and Kilkenny. 

Judge Harnett said that while his actions were wrong, he was caught
behind a person whose driving was enough to merit a charge of driving
without reasonable consideration. 

The judge said he was very familiar with the syndrome of what he called
people who loiter on national roads and hold up traffic, adding that
this was the sort of behaviour which caused accidents. He said that such
drivers were a menace. 

Judge Harnett said that either slow drivers enjoyed holding up other
people or else they were incompetent or their cars were in poor
condition.
